About us

WS Insurance Brokers is a trading name of WS Brokers Limited, registered in England and Wales under company number 13040856.

Registered office: Francis Louis House, Belmont Road, Exeter, England, EX1 2HF.

WS Brokers Limited is authorised and regulated by the Financial Conduct Authority for insurance distribution activities and as a credit broker. Our FCA Firm Reference Number is 947769. You can check our status on the Financial Services Register.

These Terms apply where your insurance requirements relate to a business enterprise. English law applies and we will communicate with you in English.

Our service

We are an independent insurance intermediary. We normally act on your behalf when arranging insurance and may:

  • Assess your insurance requirements.
  • Conduct a fact-find with your nominated insurance contact.
  • Make a personal recommendation after assessing your demands and needs.
  • Arrange cover, renewals and mid-term changes.
  • Provide ongoing administration and claims assistance.

Our recommendations are confirmed in a demands-and-needs and suitability statement.

We usually offer advice from a limited panel of selected insurers and, in some cases, a single insurer. We will identify the insurers considered and tell you if advice is based on a fair analysis of the market. We may use a specialist intermediary to access an appropriate product and will tell you when this occurs.

We may act under delegated authority from an insurer for specific activities. Where this applies, we will explain when we are acting for the insurer.

We do not accept responsibility for the solvency of any insurer.

Your duty to provide information

Under the Insurance Act 2015, you must make a fair presentation of the risk to insurers when arranging, amending and renewing your insurance.

You must carry out a reasonable search for material information known, or reasonably expected to be known, by people involved in making business decisions and arranging insurance, including directors, senior management and relevant staff.

You must ensure that all material statements of fact are substantially correct and not misleading. Estimates, forecasts and statements of belief must be made in good faith.

Material information includes anything that may influence an insurer’s decision whether to accept a risk and on what terms. This includes changes in circumstances and any inability to comply with policy conditions or warranties.

Failure to provide complete and accurate information could result in an insurer changing the policy terms or premium, cancelling or avoiding the policy, reducing a claim settlement or declining a claim.

Sums insured, limits and underinsurance

You are responsible for ensuring that sums insured, indemnity limits, declared values and business-interruption indemnity periods are adequate.

We can explain the usual basis of calculation and, on request, provide details of independent specialists such as surveyors or valuers. A property’s market value is not the same as its rebuilding cost.

If you are underinsured, insurers may apply average and reduce any claim settlement in the same proportion as the sum insured bears to the true value at risk.

Claims

You must report any incident that could lead to a claim as soon as reasonably practicable and in accordance with your policy conditions.

Do not admit liability, agree a settlement or incur costs without the insurer’s authority unless necessary to prevent further loss. Your insurer’s claims contact details will be shown in your policy documentation.

We can assist with notification and communication, but claim decisions are made by the insurer or its authorised claims handler.

Payment and client money

We normally accept payment by bank transfer, cheque, Visa and Mastercard. We do not accept American Express.

Under our agreements with insurers, premiums paid to us may be received by us as the insurer’s agent. Where risk transfer applies, payment to us is treated as payment to the insurer.

We do not pay interest on premiums held in the course of arranging and administering insurance.

Premium finance

We are a credit broker, not a lender. Instalment facilities may be available through insurers or Close Premium Finance. We may receive commission from a premium-finance provider.

A credit search may be required. We will explain the available options, the reason for any recommendation, interest and charges, and provide the relevant finance agreement before you enter into it.

If you fail to keep up payments, your credit rating may be affected and the finance provider may be entitled to require cancellation of the insurance policy. Where a finance agreement gives the provider authority to do so, we may cancel the policy as your agent and any return premium may be set against amounts outstanding.

Fees, commission and remuneration

We usually receive commission from insurers. Depending on the insurer, product, risk and work involved, this is normally between 1% and 25% of the insurer’s premium.

Where premium finance is used, we may also receive commission from the finance provider.

Our standard administration charges are:

ServiceFee
Arranging a new policy£50
Mid-term adjustment£10
Renewal£25
Replacement documents, certificates or cover notes£10
Mid-term cancellation£10, plus any insurer charge

Refunds are normally paid net of commission and subject to the insurer’s policy terms.

If we receive no commission on a policy, we will advise you of any arrangement fee before you take out the policy. We may make additional charges for complex arrangements or specialist servicing, but we will always tell you in advance.

You may request details of the commission we and any associate receive in connection with your insurance. We will provide this promptly in cash terms or, if that is not reasonably possible, explain how it is calculated.

Data protection

WS Brokers Limited is the controller of personal information used in connection with our insurance-broking services. Our data-protection contact is Thomas Winfield.

We collect and use personal, financial, health, criminal-record and risk information where necessary to obtain quotations, arrange and administer insurance, process payments, help with claims, prevent fraud and meet legal or regulatory obligations.

We may share information with insurers, premium-finance providers, claims handlers, fraud-prevention databases, credit-reference agencies and other parties involved in arranging or administering your insurance.

Further information, including your rights and how to complain about data use, is in our Privacy Notice.

Financial Services Compensation Scheme

We are covered by the Financial Services Compensation Scheme. Eligibility and compensation depend on the type of claim, the type of insurance and the circumstances at the time.

For eligible general-insurance advice and arranging claims, protection is normally 90% without an upper limit. Compulsory insurance is normally protected at 100%. More information is available from the FSCS.

Ending this agreement

You may end this agreement at any time by giving us written notice. We may end it by giving one month’s written notice to your last notified address.

On termination, we remain entitled to retain fees and commission earned before the agreement ends. Ending this agreement does not automatically cancel an insurance policy or premium-finance agreement; separate cancellation terms may apply.
